Terms & Conditions

PLEASE READ THIS STATEMENT CAREFULLY.

Introduction

These General Terms and Conditions govern the contractual relationship between Controlates [Hatice Biyik, Am Rainbach 28, 6340 Baar, info@controlates.ch, +41795770859] (hereinafter referred to as “Provider”) and the clients of the Pilates classes.

1. Services Offered

The Provider offers Pilates lessons in the following formats:

  • Online lessons (e.g. via Zoom or comparable platforms)

  • Studio group classes (mat or reformer Pilates)

  • Private lessons (studio or online)

Classes may take place in different studios. The purchased subscription is valid only for the selected course and location. The Provider reserves the right to make changes to class times, class content, or to employ qualified substitutes.

2. Conclusion of Contract

A contract is concluded with the booking confirmation by the Provider. Participation is only guaranteed after full payment has been received.

3. Booking & Payment

Booking takes place via the booking tool provided by the Provider. Payment must be made in advance via Twint or bank transfer (IBAN).
Subscriptions are personal and non-transferable. Refunds are excluded.

4. Prices & Changes

The applicable prices are shown in the booking tool or on the website under Pricing. The Provider may change prices at any time; new prices apply exclusively to future bookings.

5. Validity Period

  • A 10-class pass must be fully redeemed within 4 months of the purchase date.

  • A 20-class pass must be fully redeemed within 8 months of the purchase date.

Unused classes within these periods will expire without compensation.

6. Cancellations / No-Shows

Cancellations must be made at least 24 hours before the class begins. In case of later cancellation or no-show, the class will be fully charged or deducted from the subscription. For private lessons, the Provider may, at its discretion, require a longer cancellation period (e.g. 48 hours).

7. Health & Participation Conditions

Participation is at the participant’s own risk.
The Provider excludes any liability for slight negligence. For damages resulting from gross negligence or intent, the Provider is liable in accordance with statutory provisions.
Participants are obliged to inform the Provider of any relevant health restrictions prior to the class.
Classes do not replace medical or therapeutic treatment.
Participants are required to have sufficient accident and health insurance coverage.
The Provider reserves the right to exclude participants from classes in the event of health concerns or inappropriate behaviour.

8. Reformer Pilates (Trial Sessions)

For beginners, participation in a mandatory trial sessions (2x 60 Minutes for CHF 200) is required. Participation in regular reformer classes is only permitted after completion of this session.

9. Trial Classes

A free trial class is offered exclusively for online training and may be used once per person.
There is no entitlement to replacement, repetition, or subsequent credit.

10. Program Changes & Class Cancellations

The Provider may cancel classes for organizational or health reasons. In such cases, a replacement date will be offered or the class credited. Further claims are excluded.

11. Force Majeure

If a class cannot take place due to events of force majeure (e.g. natural disasters, pandemics, official orders), the Provider is not liable for damages. The Provider may offer substitute solutions (e.g. online instead of studio classes).

12. Confidentiality & Data Protection

Participants’ personal data will be treated confidentially and used exclusively for booking and class execution. Data will not be passed on to third parties. The Provider’s privacy policy also applies.

13. Copyright

All class content (e.g. exercises, video recordings, scripts) is protected by copyright and may not be reproduced, published, or passed on without the Provider’s written consent. Violations may be prosecuted under civil and criminal law.

14. Valuables & Studio Rules

The Provider accepts no liability for items stolen or lost before, during, or after classes.
The respective house or studio rules of the training facilities also apply.

15. Duty to Inform

Participants are obliged to inform the Provider immediately of any changes to their address, contact details, or relevant health information.

16. Final Provisions

Swiss law applies. The place of jurisdiction is Zug. Mandatory legal places of jurisdiction remain reserved.
Should any provision of these General Terms and Conditions(GTC) be invalid, the validity of the remaining provisions shall remain unaffected.
The Provider reserves the right to amend the GTC at any time.
